Public Path Diversion Order 2011
The above Order was confirmed on 24th January, 2012 under section 119 of the Highways Act 1980. The effect of the Order will be to divert a part length of Footpath 21 in the parish of Cressing away from the centre of the garden and the close proximity to the private residence, to an alternative route around the garden perimeter as shown on the Order map contained in this Order.
A copy of the Order and Order Map have been placed in and may be seen free of charge at Braintree District Council Offices, Causeway House, Braintree and at Chelmsford Public Library Market Road, Chelmsford during normal working hours. Copies of the Order and Order map are available on request from the Chelmsford Library at a charge.
The new path comes into effect on 24th March, 2012. But if a person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the Order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from 20 January 2012 make an application to the High Court. The closures are scheduled to commence on 13 February 2012 for 2 days between the hours of 07:00h and 19:00h or where appropriate signs are showing and weather permitting, and are required for the safety of the public and workforce while carriageway resurfacing and patching repairs are undertaken. Access for emergency service vehicles and pedestrians will be maintained at all times during the closure.
The Order will come into effect on 13 February 2012 and may continue in force for 18 months or until the works have been completed, whichever is the earlier.
